1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the tewanasa website and your enrollment in our residential care programs. By accessing our website or using our services, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use our website or services.
2. Definitions
For the purposes of these Terms:
- "We," "Us," or "Our" refers to tewanasa, a residential care community located in Chiang Mai, Thailand
- "You" or "User" refers to the individual accessing our website or using our services, or the legal representative of a program participant
- "Services" refers to the residential care programs offered by tewanasa, including the Morning Market Day Program, Village Residency, and Heritage Suite Residence
- "Resident" refers to an individual participating in our residential care programs
- "Website" refers to the tewanasa website accessible at tewanasa.live
3. Eligibility and Capacity
You must be at least 18 years of age to enter into this agreement. If you are enrolling a family member in our services, you represent that you have the legal authority to do so.
Our services are designed for seniors who require daily living assistance and community support but do not require intensive medical care. We reserve the right to assess whether our programs are appropriate for a prospective resident's needs.
4. Service Description
tewanasa provides non-medical residential care services in Chiang Mai, Thailand. Our programs include:
- Morning Market Day Program: A daytime program featuring meals, activities, and social engagement five mornings per week
- Village Residency: Full-time residential care in private or shared accommodation with three daily meals and structured activities
- Heritage Suite Residence: Private suite accommodation with personalized care and customized daily schedules

5. Enrollment and Admission
Enrollment in our programs requires completion of an application process, including a health assessment and consultation to ensure our services meet the prospective resident's needs.
We reserve the right to decline enrollment if we determine that our programs are not suitable for an applicant's care requirements or if enrollment would compromise the safety or wellbeing of other residents.
Enrollment is confirmed upon signing of a service agreement and payment of any required deposits.
6. Payment Terms
Monthly fees are payable in advance on the first day of each month. Payment methods accepted include bank transfer and cash payment at our facility.
All fees are quoted in Thai Baht (฿). Late payments may incur administrative fees as specified in the service agreement.
Fee schedules are subject to change with 60 days' written notice to enrolled families.
We do not provide refunds for unused services within a paid monthly period, except in cases of early termination as outlined in Section 10.
7. Services Provided and Limitations
Our services include daily living assistance, social activities, meals, and care companion support as outlined in individual care plans. We coordinate with external healthcare providers for medical services.
We are not a medical facility. We do not provide medical treatment, nursing care, or specialized medical services. Residents requiring medical attention will be referred to appropriate healthcare providers.
Additional services not included in standard monthly fees, such as specialized transportation or external medical appointments, may be available at additional cost.
8. Resident Rights and Responsibilities
Residents have the right to:
- Be treated with dignity and respect
- Privacy in personal care and accommodations
- Participate in developing their care plan
- Voice concerns or complaints without fear of retaliation
- Receive visitors during designated hours
- Manage personal finances and belongings
Residents and their families are responsible for:
- Providing accurate health and personal information
- Timely payment of fees
- Respectful conduct toward staff and other residents
- Following facility policies and procedures
- Notifying staff of changes in health status or care needs
9. Facility Policies
Residents and visitors must comply with facility policies regarding visiting hours, safety protocols, and community standards. Policies are provided upon enrollment and posted within the facility.
We reserve the right to modify facility policies with reasonable notice to residents and families.
10. Termination of Services
Either party may terminate the service agreement with 30 days' written notice. We may terminate services immediately if:
- Payment obligations are not met after reasonable notice
- The resident's care needs exceed our service capabilities
- The resident's behavior poses a safety risk to themselves, staff, or other residents
- The service agreement terms are violated
Upon termination, any prepaid fees for unused services will be refunded on a prorated basis, minus any applicable administrative fees or outstanding charges.
11. Limitation of Liability
To the fullest extent permitted by Thai law, tewanasa shall not be liable for any indirect, incidental, or consequential damages arising from use of our services or facilities.
Our liability for direct damages shall be limited to the amount of fees paid for services in the three months preceding the event giving rise to the claim.
This limitation does not apply to liability for personal injury caused by our negligence or willful misconduct.
12. Privacy and Confidentiality
We are committed to protecting the privacy of residents and their families. Our handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Resident health information and personal records are maintained confidentially and shared only with authorized individuals as permitted by law and our privacy practices.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Thailand.
Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.
14. Dispute Resolution
We encourage families to communicate concerns directly with our management team. Many issues can be resolved through informal discussion.
If informal resolution is unsuccessful, disputes may be referred to mediation before pursuing legal action. Both parties agree to participate in good faith mediation if requested.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date.
Material changes affecting enrolled residents will be communicated via email or written notice at least 30 days before the changes take effect.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
